A group of #librarians say that the @internetarchive is a library which that the four major publishers' lawsuit against them threatens the development of both print and digital collections. https://www.insidehighered.com/views/2023/03/17/librarians-should-stand-internet-archive-opinion
Today is the day oral arguments officially start in the Big Publishing/Copyright Cartel's lawsuit against the @internetarchive which would effectively kill the great service and perhaps #libraries altogether if it goes their way.
Here's a couple of posts on how we got here: https://www.theverge.com/2023/3/20/23641457/internet-archive-hachette-lawsuit-court-copyright-fair-use
https://www.battleforlibraries.com/
And here's the oral argument schedule and how to be involved since this will affect all of us one way or another... http://blog.archive.org/2023/03/17/heres-how-to-participate-in-mondays-oral-arguments/
The hearing has started, follow the live blog here: https://controlleddigitallending.org/2023/03/20/hachette-v-ia-liveblog/
Here's a couple of articles to read post hearing and now we'll wait it out.
Ars' Ashley Belanger with a post titled: "Book publishers with surging profits struggle to prove #InternetArchive hurt sales" https://arstechnica.com/tech-policy/2023/03/book-publishers-with-surging-profits-struggle-to-prove-internet-archive-hurt-sales/
And Mike Masnick (@mmasnick) with this fitting title: "Book Publishers Won’t Stop Until #Libraries Are Dead" https://www.techdirt.com/2023/03/22/book-publishers-wont-stop-until-libraries-are-dead/
No matter what happens, I'm sure this will be appealed and it's likely that SCOTUS will have to be involved in the not too distant future.
Very gutted to hear this decision on a Friday Night Dump no less. I already said this will be appealed no matter what happens but it's not looking good for the future of the @internetarchive and most likely #libraries as we know them and I hope the Second Circuit understands what's at stake. https://www.docdroid.net/qM0MbI7/ia-sjm-order-pdf
@mmasnick has more on this: https://mastodon.social/@mmasnick/110081107772033421
As we all expect, the @internetarchive will appeal and the fight for the future of the #internetarchive and #libraries as we know it will continue. https://blog.archive.org/2023/03/25/the-fight-continues/
@brewsterkahle with the statement which is here.
EDIT: Posted the corrected link.
Here's @mmasnick with this very good post-ruling analysis. https://www.techdirt.com/2023/03/27/publishers-get-one-step-closer-to-killing-libraries/
Basically Publishers and the Copyright Cartel are basically one win away from not only killing the @internetarchive but also #libraries as we know them. I and many others hope that the Second Circuit gets it right to keep this alive.
The @internetarchive has submitted a letter to the district court hoping that there will be minor changes pending appeal. https://mastodon.archive.org/@internetarchive/110872318293638005
Remember: the best way to support them is by donating which is in this link: https://archive.org/donate
EDIT: added donation link.
The record labels have now joined publishers and the copyright cartel in the fight to outright kill the #internetarchive (@internetarchive) as they have filed a lawsuit of their own at the very same SDNY federal court. https://torrentfreak.com/record-labels-hit-internet-archive-with-new-400m-copyright-lawsuit-230812/
Here's a very good report on the publishers, record labels, and copyright cartel's goal to not only kill the #internetarchive (@internetarchive) but probably #libraries altogether. https://www.nytimes.com/2023/08/13/business/media/internet-archive-emergency-lending-library.html
Archival links: https://web.archive.org/web/20230814183308/https://www.nytimes.com/2023/08/13/business/media/internet-archive-emergency-lending-library.html

FACT: if libraries were created today, they would be extinct. Pay very close attention to this case as this would be a very huge blow to the profession of preservation and archiving plus a win for privatization and control.
Also, here's a very good post on how you can help the #internetarchive (@internetarchive) survive and we must let them exist. https://sfba.social/@morgandawn/110885357263374893
Again, the best way to help them exist is by donating, which is in this link: https://archive.org/donate
Yep, @Lance_Ulanoff is right here: we need more people to pay attention to these cases and find ways to #archive the #internetarchive (@internetarchive) before it's too late. https://www.techradar.com/computing/websites-apps/someone-needs-to-save-the-internet-archives-from-the-lawyers-and-i-have-an-idea
Vice and Decrypt echoed that sentiment three years ago and that's hasn't changed. https://mastodon.sdf.org/@joeo10/104332840359528864
@textfiles and @brewsterkahle I hope you're both taking this into serious consideration for all of our sakes.
More on the lower court's disgraceful decision: "Broadly, this injunction will result in a significant loss of access to valuable knowledge for the public. It means that people who are not part of an elite institution or who do not live near a well-funded public library will lose access to books they cannot read otherwise. It is a sad day for the Internet Archive, our patrons, and for all libraries." - @internetarchive

A update:
Today, the @internetarchive has officially submitted their appeal, formally setting up for the Second Circuit to take it up. https://blog.archive.org/2023/09/11/internet-archive-files-appeal-in-publishers-lawsuit-against-libraries/
A bit of a update: the @internetarchive is asking the Second Court of Appeals for a deadline of December 15 for submitting its opening brief. https://www.libraryjournal.com/story/internet-archive-plans-to-file-opening-brief-in-december-in-fight-against-ongoing-lawsuit

UPDATE: the @internetarchive has formally submitted their opening brief in their appeal. https://blog.archive.org/2023/12/15/internet-archive-defends-digital-rights-for-libraries/
@eff's Press Release is here: https://www.eff.org/press/releases/internet-archive-files-appeal-brief-defending-libraries-and-digital-lending-big
The formal brief #PDF is here: https://www.eff.org/files/2023/12/15/internet_archives_opening_brief_public.pdf
Here's some good coverage of the appeals brief:
UPDATE: the @internetarchive has filed their final brief to the 2nd Circuit in their appeal against publishers and the copyright cartel seeking to transform books into Netflix. https://blog.archive.org/2024/04/19/internet-archive-stands-firm-on-library-digital-rights-in-final-brief-of-hachette-v-internet-archive-lawsuit/
In relation to this, honestly I don't like their chances of winning but I do hope they deliver a miracle of an upset.
In the event they lose, be sure to read this and please back up and download everything that you want now rather than waiting until it's too late. https://old.reddit.com/r/DataHoarder/comments/1bswhdj/if_there_is_a_book_on_internet_archive_your/
Also, plan to find other ways to preserve your projects & not solely relying on the IA as it can disappear overnight.

The @internetarchive's appeal against publishers and the copyright cartel is scheduled to be heard on June 28th.
Here's a nice video to understand how the IA began and how libraries such as this one needs to be protected. https://flaminghydra.com/issue-97/#the-internet-archive-is-a-library
h/t @maria for this one!

Here's a look at how the @internetarchive plans to defend their lending practices ahead of their June 28th appeals court hearing in front of the Second Circuit after revealing that they had to remove over 500,000 books from their systems. https://arstechnica.com/tech-policy/2024/06/internet-archive-forced-to-remove-500000-books-after-publishers-court-win/

Here's the best paywall-free piece I could find in terms of what went down at the Second Circuit hearing yesterday as the @internetarchive fights for its survival in all likelihood. https://arstechnica.com/tech-policy/2024/06/appeals-court-seems-lost-on-how-internet-archive-harms-publishers/

This ruling is a HUGE blow to not only the #InternetArchive (@internetarchive) but #digitalpreservation and #libraries as a whole. https://www.wired.com/story/internet-archive-loses-hachette-books-case-appeal/
https://archive.ph/9irhZ
Official document is here: https://storage.courtlistener.com/recap/gov.uscourts.ca2.60988/gov.uscourts.ca2.60988.306.1.pdf
I fully expect SCOTUS to not take up this case and I feel the floodgates are officially open for more lawsuits to be filed against the #InternetArchive (@internetarchive) where they're now on borrowed time as far as a organization goes which would be a sad end.
This from five months ago is still relevant: https://old.reddit.com/r/DataHoarder/comments/1bswhdj/if_there_is_a_book_on_internet_archive_your/
It's time to prepare for a likely scenario where the #IA won't exist in 2-5 years and we need to find ways to mirror and backup our projects somewhere else.
As far as #libraries go, what a blow this is for them as a whole as I expect major ramifications for the future of libraries which really doesn't look good. A notable example:
https://ninelives.karawynnlong.com/the-coming-enshittification-of-public-libraries/
h/t @karawynn
"If #libraries were created today, they won't be allowed to exist thanks to publishers and the copyright cartel."
Still rings true.
Here's @mmasnick on this hugely bad ruling for not only the #InternetArchive, the #internet and #digitalpreservation, but for #libraries as a whole. https://www.techdirt.com/2024/09/05/second-circuit-says-libraries-disincentivize-authors-to-write-books-by-lending-them-for-free/
Read it and weep.
I don't usually link to Bryan due to his questionable views but in this case, he's mostly spot on here except at the end where he blames solely on the IA.
"With more legal action on the horizon, how long before Archive.org closes?"
https://lunduke.locals.com/post/6079435/the-internet-archive-loses-appeal-as-expected
Here's a very good op-ed from Public Knowledge CEO Chris Lewis on what this ruling means for the future of #libraries which sadly doesn't look good unless Congress acts, which I feel it's unlikely to come anytime soon if not ever. I love to be wrong though. https://www.technologyreview.com/2024/09/11/1103838/why-a-ruling-against-the-internet-archive-threatens-the-future-of-americas-libraries/
https://archive.ph/kuKT5
This from @molly0xfff is a very good as well making a case into why publishers hate libraries and how this ruling basically puts the existence of libraries at risk. https://www.citationneeded.news/hachette-v-internet-archive/
#library #books #crisis #InternetArchive #libraries #print #digital #preservation
As many people mentioned, the #InternetArchive is facing a much bigger lawsuit from the music labels that would not only kill the Great 78 Project, but effectively kill the organization as well, hence why I said be prepared for a scenario where they'll cease to exist in 2-5 years.
Here's two very good pieces on the @internetarchive's current fight for it's survival, and it's not looking good. :(

https://archive.ph/85JPm
The @internetarchive just got catastrophically hacked and this is bad obviously. https://www.bleepingcomputer.com/news/security/internet-archive-hacked-data-breach-impacts-31-million-users/
With the organization fighting for its very existence right now (see above posts/toots), this is at a worst time. I'm sure the publishers, record labels, and the copyright cartel have something to do with this as they surely paid these groups to do this.
As I and many others widely expected, the @internetarchive has formally decided not to take the book publishing lawsuit to the SCOTUS, thus giving #libraries a massive blow as I mentioned already.
https://blog.archive.org/2024/12/04/end-of-hachette-v-internet-archive/
Plus, this officially starts the clock to the #InternetArchive's inevitable demise as more lawsuits are coming their way and what a sad day that will be when I read their shutdown post down the road.
